TERMS OF SALES

These "General Conditions" apply to the sale of "Activity(ies)" / "Service(s)") by the "Mountain Guide" Baptiste Locatelli domiciled at 340 chemin des Carrières 73230 Saint Alban Leysse, under number SIRET 81768792400024, email baptiste@alpes-ascensions.com, mobile 07.49.83.27.87, website www.alpes-ascensions.com, for the benefit of any natural or legal person, hereinafter ( s) “Participant(s) / Customer(s)”),
Either directly (at the counter, outside the establishment), or remotely (telephone, post, e-mail, or on the Alpes Ascensions website).

The purchase of an Activity sold by the Mountain Guide implies knowledge and pure and simple acceptance of these general conditions of sale.

Article 1 - Definition of the service


The Mountain Guide delivers a service of supervision, animation, teaching and training in safety of mountaineering and its assimilated activities, and exercises the prerogatives listed in article 1 of the decree of 16 June 2014 relating to the specific training of the state mountaineering diploma – high mountain guide.
These general conditions relate only to the sale of mountaineering and similar activities within the meaning of the aforementioned provisions, to the exclusion of any other transport, accommodation, food or equipment rental service. .

Article 2 - Contract - Sale of the Activity

The contract consists of two parts applicable in the event of contradictions in the following order: the individual agreements between the mountain guide and the client, and these general conditions.
The Activity is sold as soon as the parties (Mountain Guide and Client(s)) have agreed on the main characteristics and the price of the service. It is then an oral agreement, unless one of the parties expressly issues the reservation that the contract must be in writing.
The registration request is made directly to the Mountain Guide, by telephone at 07.49.83.27.87, or by e-mail at baptiste@alpes-ascensions.com, and mentions the surnames, first name, address, and contact details of customer contact.
The Mountain Guide offers the Client a registration form which includes the main characteristics and the price of the Activity, and sends him these general conditions.
Registration is effective after the customer has completed the form and paid a deposit equal to 30% of the price of the Activity, and the Mountain Guide has acknowledged receipt.
In the absence of acknowledgment of receipt from the Mountain Guide within 7 days, the registration will be deemed not validated, the Mountain Guide however retaining the possibility of confirming this registration after this period and until Activity day.
If necessary, the Mountain Guide defines the date from which failure to pay the deposit will result in the cancellation of the activity.
The balance of the amount due is paid to the Mountain Guide upon return from the Activity.

Sale at the counter in the usual premises of the Mountain Guide: These general conditions are displayed and freely available for consultation.
Sale concluded outside the establishment (premises other than the usual premises): Before any order, the Mountain Guide provides the Customer with the contractual information. He then gives him a copy of the dated and signed contract confirming their express agreement on a paper medium, or with his agreement, on a durable medium.
In the event of a sale concluded at a distance (telephone, post, etc.): Before any order, the Mountain Guide provides the Customer with the contractual information in a way that allows their conservation and reproduction.
In the event of sale concluded at a distance exclusively by exchange of e-mails:  The Mountain Guide ensures that the Customer acknowledges his obligation to pay when placing his order, and includes the mention "order with payment obligation” as well as the means of payment accepted for the conclusion of the contract. The Mountain Guide acknowledges receipt of the registration request by e-mail or by any other means, and provides the Client with the confirmation and details of the contract on a durable medium.
In the event of a sale concluded at a distance with online payment: The Mountain Guide sets out the steps to be followed for the conclusion of the contract and the means allowing the Customer to identify any errors:
1/ The Customer checks the details of the order and its total price;
2/ He confirms his order;
3/ The Mountain Guide acknowledges receipt of the order and provides the Customer with confirmation of the contract on a durable medium. The Mountain Guide includes the words "order with obligation to pay", the means of payment accepted and the languages offered for the conclusion of the contract.

Article 3 - Right of withdrawal

The Customer is informed that in accordance with the provisions of Article L. 221-28 of the Consumer Code, registration for an Activity is firm and definitive and that he does not benefit from a right of withdrawal.

Article 4 - Price - Additional costs - Terms of payment - Complaint

The price corresponds to the fees of the Mountain Guide. It relates solely to the provision of supervision of the Activity to the exclusion of any other service. It means all charges included.
The price takes into account the habits and customs of the profession, the number of participants and their technical and physical level, and the characteristics of the objective pursued (technical difficulty, elevation, commitment, etc.).
The Mountain Guide applies either a basic daily rate, which varies according to the winter and summer season, or a rate defined according to the objective pursued.
The price communicated is deemed to correspond to the price of the Activity due by each of the participants, unless the Mountain Guide has specified that it is a global price of the Activity to be shared between all the participants. attendees.
Any additional costs incurred by the activity (transport, ski lifts, drinks, food, etc.) are ordered, paid for and paid for directly by the Client(s), including those of the Mountain Guide.
Methods of payment: The price of the Activity is to be paid by bank check payable to Baptiste Locatelli, bank transfer (Locatelli Baptiste IBAN: FR76 1022 8028 5528 6059 0020 016 BIC: LAYDFR2W DOMICILIATION: GRAND CHAMBERY).
Complaints: All complaints are sent by registered mail with acknowledgment of receipt to the address of the Mountain Guide, no later than one month after the occurrence of the event giving rise to the request.

Article 5 - Modification or cancellation of the Activity

Mountain activities are subject to hazards related to weather, snow and terrain conditions, attendance, as well as the experience, technical abilities and physical condition of the participants.
To ensure the safety of property and people, the proposed Activity may be canceled or modified by the Mountain Guide at any time before, at the start, or during its execution.
• In the event of modification of the Activity by the Mountain Guide before or during the Activity: the price of the alternative itinerary will be applied according to customs and practices, without being able to be lower than the basic daily price of the Guide. de Montagne mentioned in article 4, and without the Customer being able to claim any compensation. In the event of modification of the Activity by the Customer, in particular for insufficient physical or technical prerequisites declared, the price of the initial objective may be applied in full.
• In the event of cancellation of the Activity by the Mountain Guide prior to the activity, [specify the conditions for canceling the Activity. Eg: priority is given to postponing the activity. In the event of refusal, the deposit is returned to the Client(s), less any sums already committed by the Mountain Guide for the Activity (booking or travel costs, etc.). If the minimum number of participants set is not reached for the realization of an Activity organized collectively, the Mountain Guide may decide not to carry out the Activity. In this case, the sums paid by the Client(s) are reimbursed to him. In the case of a group activity where the minimum number of participants set is not reached, but the Customer(s) shows the will to maintain the activity all the same, the additional price will be requested.
• In the event of cancellation of the Activity by the Client(s):
- Up to 30 days before the start of the Activity: the deposit is returned, except sums already committed or advanced.
- From 30 days to 4 days before the start of the Activity: the deposit is due.
- Less than 4 days before the start of the Activity: the full price is due.

Article 6 - Technical and physical prerequisites - Background

Technical, physical or experience prerequisites may condition the Client's access to the Activity. The Customer who wrongly declares to respect these prerequisites, and who has a technical, physical level or experience lower than that declared, is entirely responsible for the consequences of all types which could result therefrom.
In particular, the Client must declare to the Mountain Guide any health problem, medical history, occasional or long-term treatment, accident, likely to affect his physical or psychological health, as well as any particular apprehension (dizziness, history of accident , fears, etc.).

Article 7 - Organization of the Activity

Hours: For the smooth running of the Activity, the Customer undertakes to respect the meeting times communicated on time. Failure to respect the appointment schedule by the Customer may lead to the modification of the Activity.
Number of participants: A maximum number of participants may be set for each Activity with regard to habits and customs, the physical and technical level of the participants, and the weather and terrain conditions. In the event of an Activity organized collectively, a minimum number of participants may be set, as well as the date from which an insufficient number of registered members does not allow it to be carried out.

Article 8 - Material

Collective equipment: The price includes collective and safety equipment.
Individual equipment: The Client has his own technical and safety equipment adapted to the Activity carried out, in accordance with the instructions provided. The Customer is informed that he is solely responsible for his equipment and any damage that may result for him or for a third party. In case of doubts as to the obsolescence or unsuitability of his individual equipment, he is responsible for referring it to the Mountain Guide. The Mountain Guide may be required to provide the Client with the technical and safety equipment necessary for the performance of the Activity, in which case the Client undertakes to wear and use this equipment throughout the activity, unless otherwise indicated. expressly contrary to the Mountain Guide.

Article 9 - Responsibilities - Specific environment

Mountaineering takes place in a specific high mountain environment, which involves objective and random natural risks (rockfalls, seracs, crevasses, avalanches, etc.). Supervision by a Mountain Guide does not eliminate these natural risks. The participant is aware of the dangers to which he exposes himself.
The Mountain Guide is subject to a security obligation of means and not of result. He implements all the means at his disposal, including renunciation, to prudently and diligently ensure the safety of the participant, who retains an active role in carrying out the activity. The participant takes care of his own safety and that of third parties. He must respect the rules of safety and behavior that flow from common sense, as well as those transmitted by the Mountain Guide.
It is recalled that any activity other than mountaineering that the Practitioner may be required to practice during the course of the outing (cycling, swimming, picking, paragliding, etc.), is practiced under the exclusive personal responsibility of the Practitioner. , the responsibility of the Mountain Guide can in no way be engaged as a result.

Article 10 - Insurance and Rescue


The Mountain Guide benefits from professional civil liability insurance in France and throughout the world which covers damage resulting from their actions as a professional, including search, rescue and repatriation costs: ALLIANZ RC pro, contract n°621 38 930, guarantees the pecuniary consequences of civil liability that may be incurred due to bodily, material or immaterial damage caused to others, during or on the occasion of the activities. However, it is specified that outside of France, this insurance cannot replace any foreign legal obligation imposing insurance on the spot and, consequently, does not exempt the Subscriber from the obligation to insure in accordance with the texts premises. This insurance does not replace the Customer's individual civil liability for damages that he may cause to himself or to third parties, or that may result from an external natural phenomenon.
It is up to the Customer(s) to take out individual civil liability insurance for the practice of mountaineering and mountain sports, without limitation of place and altitude, including assistance, search, rescue and repatriation. The Mountain Guide informs the Client that he has the option of taking out annual or daily insurance, it being specified that it is the Client's responsibility to ensure that the required guarantees are effectively covered.

Article 11 - Image rights

The Client authorizes the Mountain Guide to use without limitation for promotional and commercial purposes, by way of reproduction, representation, projection and adaptation, the images (photos and videos) taken during the supervised Activity, unless otherwise indicated. expressed by the Customer served before the start of the Activity.
The parents of the minor Client grant the Mountain Guide the authorization to use the images of the minor Client under the same conditions.

Article 12 - Settlement of disputes and applicable law

In case of disputes, the customer must send a registered letter to the mountain guide to explain his complaint and promote an amicable settlement. The mountain guide has two (2) months to respond, and if there is no response or if it does not suit the client, the latter may, in accordance with article L.612-1 of the consumer code, refer to the Mediator. consumption MCP Mediation:

The reference language for the settlement of any disputes is French. All disputes will fall under the jurisdiction of the courts on which the head office of the Mountain Guide depends.

Article 13 - Processing of personal data


The information collected in the registration form is recorded in a computer file. The data collected will not be communicated to third parties and will be kept for five years.
You can access the data concerning you, rectify them, request their deletion, exercise your right to limit the processing of your data, or ask any other question, by contacting the mountain guide.
If you believe, after contacting us, that your "Data Protection" rights have not been respected, you can consult the cnil.fr website or file a complaint with the CNIL.
